In California cannabis cultivation will be regulated by the States Department of Food and Agriculture, which is mandated in Assembly Bill 243 to establish a Medical Cannabis Cultivation Program. More details on requirements under this program will be forthcoming by 2018.

MMRSA currently waives municipal rights to legislate this industry unless regulations are in place by March 1, 2016. For most jurisdictions, this is too soon to develop effective zoning and oversight; many are establishing emergency bans.
